1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player," "User," or "you") and phokd ("phokd," "we," "us," or "our"), governing your access to and use of the phokd online gaming platform available at phokd.app and all associated services, features, content, and applications (collectively, the "Platform").

By registering an account, accessing the Platform, or placing any wager on phokd, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy and Responsible Gaming Policy, each of which is incorporated herein by reference. If you do not agree to these Terms, you must immediately cease using the Platform.

These Terms apply to all users of the phokd Platform, including players based in the Philippines and any other jurisdiction where access to phokd is not prohibited by applicable law.

2. Eligibility

To register and use the phokd Platform, you must satisfy all of the following eligibility requirements:

You must be at least 21 years of age, as required by PAGCOR regulations governing online gaming in the Philippines.
You must be a natural person with full legal capacity to enter into binding contracts under Philippine law.
You must not be a resident of, or accessing the Platform from, any jurisdiction where online gambling is prohibited by applicable law.
You must not be a current employee, contractor, director, officer, or immediate family member of phokd or any of its affiliated entities, game providers, or technology partners.
You must not have been previously excluded or suspended from the phokd Platform for any reason.

phokd reserves the right to request documentary proof of age and identity at any time. Failure to provide satisfactory verification documents within the timeframe specified by phokd may result in the suspension or permanent closure of your account and the withholding of any pending withdrawals pending investigation.

By registering an account, you represent and warrant that you meet all eligibility requirements set out in this section. Any misrepresentation of your eligibility constitutes a material breach of these Terms.

3. Account Registration

To access the full features of the phokd Platform, you must register a player account. The following rules apply to account registration and maintenance:

One Account Per Player: Each individual may register and maintain only one phokd account. The creation of multiple accounts by a single individual is strictly prohibited and constitutes a material breach of these Terms.
Accurate Information: You must provide accurate, current, and complete information during registration, including your full legal name, date of birth, Philippine mobile number, and any other information requested. You are obligated to update your account information promptly if any details change.
Account Security: You are solely responsible for maintaining the confidentiality of your phokd login credentials, including your username and password. You must not share your login credentials with any third party. phokd will not be liable for any loss or damage arising from unauthorized access to your account resulting from your failure to maintain adequate security.
KYC Verification: phokd is required to conduct Know Your Customer (KYC) verification in accordance with PAGCOR regulations and applicable anti-money laundering laws. You agree to provide all documentation requested for KYC purposes, including but not limited to a valid government-issued photo ID (e.g., Philippine passport, driver's license, SSS ID, or UMID card) and proof of address.
Account Non-Transferability: Your phokd account is personal to you and may not be transferred, sold, or assigned to any other person under any circumstances.

4. Deposits & Withdrawals

All financial transactions on the phokd Platform are conducted in Philippine Peso (PHP / ₱) unless otherwise specified. The following terms govern deposits and withdrawals:

Accepted Payment Methods: phokd accepts deposits and processes withdrawals via GCash, PayMaya, BPI, BDO, Metrobank, and UnionBank. phokd reserves the right to add, modify, or remove accepted payment methods at any time without prior notice.
Minimum Deposit: The minimum deposit amount is ₱100. Minimum and maximum deposit limits may vary by payment method and are subject to change.
Withdrawal Processing: Withdrawal requests are processed subject to completion of KYC verification. phokd aims to process withdrawal requests within the timeframes published on the Platform, but does not guarantee processing times. phokd reserves the right to conduct additional verification checks before processing any withdrawal.
Withdrawal to Registered Methods Only: Withdrawals will only be processed to payment accounts registered in your name and linked to your phokd account. phokd will not process withdrawals to third-party accounts.
Anti-Money Laundering: phokd is obligated to comply with Philippine anti-money laundering laws, including the Anti-Money Laundering Act (AMLA) as amended. phokd may request additional documentation for any transaction that triggers AML review thresholds. Suspicious transactions will be reported to the appropriate authorities as required by law.
Chargebacks: Initiating a chargeback or payment reversal in respect of a phokd deposit is a violation of these Terms. phokd reserves the right to suspend your account and pursue recovery of any funds subject to a chargeback.

5. Bonuses & Promotions

phokd may offer bonuses, free bets, cashback offers, and other promotional incentives to players from time to time. The following general terms apply to all phokd promotions:

All bonuses are subject to specific wagering requirements, minimum odds, game restrictions, and time limits as set out in the individual promotion terms published on the Platform.
Bonuses may only be claimed once per player, per household, per device, and per IP address, unless the specific promotion terms state otherwise.
phokd reserves the right to withdraw, modify, or cancel any bonus or promotion at any time without prior notice.
Any attempt to abuse, exploit, or circumvent bonus terms — including but not limited to the use of multiple accounts, collusion, or systematic wagering strategies designed to extract bonus value without genuine play — constitutes a material breach of these Terms. phokd reserves the right to void any bonus and associated winnings and to suspend or permanently close the accounts of players found to be engaging in bonus abuse.
Bonuses credited to your account do not constitute real money until applicable wagering requirements have been met in full.

6. Prohibited Conduct

You agree that you will not engage in any of the following conduct while using the phokd Platform:

Providing false, misleading, or fraudulent information during registration or at any other time;
Registering more than one account or using another person's account;
Using the Platform for any unlawful purpose, including money laundering or fraud;
Attempting to reverse-engineer, decompile, disassemble, or otherwise tamper with any software or technology underlying the Platform;
Using automated software, bots, scripts, or any other tools to interact with the Platform in a manner not intended for human players;
Colluding with other players or engaging in any form of cheating, match-fixing, or manipulation of game outcomes;
Engaging in any conduct that disrupts, damages, or impairs the integrity or availability of the Platform or its services;
Accessing the Platform from a jurisdiction where online gambling is prohibited by applicable law;
Allowing any person under the age of 21 to access or use your phokd account.

phokd reserves the right to investigate any suspected prohibited conduct and to take appropriate action, including immediate account suspension, permanent closure, forfeiture of balances, and referral to law enforcement authorities where warranted.

7. Intellectual Property

All content on the phokd Platform — including but not limited to software, source code, game content, graphics, logos, trademarks, trade names, text, audio, video, and the overall look and feel of the Platform — is the exclusive property of phokd or its licensors and is protected by applicable intellectual property laws, including the Intellectual Property Code of the Philippines (Republic Act No. 8293).

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal, non-commercial entertainment purposes in accordance with these Terms. This licence does not include any right to:

Copy, reproduce, distribute, or publicly display any content from the Platform;
Modify, adapt, translate, or create derivative works based on Platform content;
Use any phokd trademarks, logos, or brand elements without prior written consent;
Frame or mirror any portion of the Platform on any other website or application.

Any unauthorised use of phokd intellectual property is a violation of these Terms and applicable law, and phokd reserves all rights to pursue legal remedies.

8. Limitation of Liability

To the fullest extent permitted by applicable Philippine law, phokd, its directors, officers, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Platform, including but not limited to:

Loss of winnings or anticipated profits;
Loss of data or account information;
Interruption or unavailability of the Platform due to technical issues, maintenance, or circumstances beyond phokd's reasonable control;
Errors or inaccuracies in game results caused by software malfunctions, provided that phokd takes reasonable steps to investigate and rectify such errors;
Unauthorised access to your account resulting from your failure to maintain adequate security of your login credentials.

In the event of a technical malfunction that affects the outcome of a game, phokd reserves the right to void the affected bets and return the wagered amounts to the players' accounts. phokd's total aggregate liability to you for any claim arising under these Terms shall not exceed the total amount deposited by you into your phokd account in the thirty (30) days immediately preceding the event giving rise to the claim.

Nothing in these Terms shall limit or exclude phokd's liability for fraud, gross negligence, or any other liability that cannot be excluded or limited under applicable Philippine law.

9. Responsible Gaming

phokd is committed to promoting responsible gaming and minimising the risk of problem gambling among its players. The following responsible gaming measures are available to all phokd account holders:

Deposit Limits: You may set daily, weekly, or monthly deposit limits on your account at any time via your account settings. Requests to decrease a limit take effect immediately; requests to increase a limit are subject to a cooling-off period.
Session Time Reminders: You may configure session time alerts to notify you when you have been playing for a specified duration.
Self-Exclusion: You may request self-exclusion from the phokd Platform for a period of your choosing, ranging from 24 hours to permanent closure. Self-exclusion requests are processed promptly and cannot be reversed during the elected exclusion period.
Reality Checks: Periodic on-screen reminders of your session duration and net gaming activity are available and can be configured in your account settings.

10. Account Suspension & Termination

phokd reserves the right to suspend, restrict, or permanently close your account at any time, with or without prior notice, in any of the following circumstances:

You have breached any provision of these Terms;
phokd has reasonable grounds to suspect fraudulent, abusive, or unlawful activity on your account;
You have failed to complete KYC verification within the required timeframe;
phokd is required to do so by applicable law, regulation, or order of a competent authority;
You have requested self-exclusion under phokd's Responsible Gaming policy.

Upon termination of your account for breach of these Terms, phokd reserves the right to forfeit any balance remaining in your account, including any bonus funds and associated winnings. Where your account is closed for reasons other than breach — such as at your own request or due to regulatory requirements — any verified real-money balance will be returned to you via your registered payment method, subject to completion of any outstanding KYC requirements and AML checks.

You may request the closure of your phokd account at any time by contacting our customer support team. Account closure requests are processed within a reasonable timeframe, and you remain responsible for any activity on your account until closure is confirmed.

11. Privacy

phokd collects, processes, and stores your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the phokd Platform, you consent to the collection and processing of your personal data as described in the Privacy Policy.

12. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

In the event of any dispute between you and phokd arising from your use of the Platform, both parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the competent courts of Makati City, Metro Manila, Philippines.

Nothing in this section shall prevent phokd from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.

13. Amendments to These Terms

phokd reserves the right to amend, update, or replace these Terms at any time at its sole discretion. When material changes are made, phokd will notify registered players via the email address associated with their account and/or by posting a prominent notice on the Platform.

The date of the most recent revision will be indicated at the top of this page. Your continued use of the phokd Platform following the posting of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must cease using the Platform and may request account closure in accordance with Section 10.

It is your responsibility to review these Terms periodically to stay informed of any updates. phokd recommends checking this page each time you access the Platform.
